Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of GEX Session Monitor (the “Service”). By creating an account, starting a trial, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

GEX Session Monitor presents an interpretation of third-party options-gamma (GEX) data for index and futures markets (including SPX, ES, NDX, and NQ). It transforms raw market data into a deterministic rule-based read of the session and an optional AI-generated summary. It is a visualization and analysis aid — it does not execute trades, connect to your brokerage, manage money, or guarantee any outcome.

2. Trading risk & assumption of risk

Trading and investing in futures, options, and other financial instruments involves substantial risk of loss and is not suitable for every person. You can lose some or all of your capital. Leverage can work against you as well as for you. Past performance, hypothetical results, and any patterns surfaced by the Service are not indicative of future results.

You alone are responsible for your trading and investment decisions. You should evaluate your own financial situation and consult a licensed financial, legal, and tax professional before making any decision. By using the Service, you acknowledge and accept all risks associated with trading, and you agree that you use any information from the Service entirely at your own risk.

3. Data accuracy & “as is” availability

Market data is sourced from third-party providers and may be delayed, incomplete, inaccurate, or unavailable. The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, timeliness, non-infringement, or uninterrupted availability. We do not warrant that the Service, its data, or its outputs are correct, reliable, or error-free, and we are not responsible for decisions you make based on them.

4. Limitation of liability

To the maximum extent permitted by law, in no event will GEX Session Monitor, its operator, or its suppliers be liable for any trading losses or for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service — whether based in contract, tort, negligence, strict liability, or otherwise, and even if advised of the possibility of such damages. To the extent any liability cannot be excluded, our total aggregate liability for any claim is limited to the amount you paid us for the Service in the three (3) months preceding the event giving rise to the claim.

5. Eligibility & accounts

You must be at least 18 years old and legally able to enter into these Terms and to trade in your jurisdiction. Authentication is handled through Google sign-in; you are responsible for maintaining the security of your account and for all activity under it. You agree to provide accurate information and to notify us of any unauthorized use.

6. Subscriptions, billing & trial

The Service offers a free trial followed by a paid Pro subscription, billed monthly or annually. Payments are processed by our payment provider, Paddle, which acts as the Merchant of Record for your purchase; your transaction is also subject to Paddle’s buyer terms. Subscriptions renew automatically at the end of each billing cycle unless cancelled beforehand. You can cancel at any time; your access continues until the end of the paid period. Prices may change with prospective notice; changes do not affect the current paid period. Refunds are governed by our Refund Policy.

7. Acceptable use

You agree not to:

• resell, redistribute, sublicense, or publicly display the Service’s data or outputs;
• scrape, harvest, or programmatically extract data from the Service, or exceed reasonable usage;
• reverse engineer, decompile, or attempt to access non-public parts of the Service or its source;
• share, resell, or provide access to your account to others;
• use the Service to violate any law, exchange rule, or third-party data-licensing term.

8. Intellectual property

The Service, including its software, rule engine, design, and content (excluding third-party market data), is owned by us and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal trading research while your subscription is active. Market data remains the property of its respective providers.

9. Third-party services

The Service relies on third parties including a market-data provider, Google Firebase (authentication and database), Vercel and Google Cloud (hosting and compute), Anthropic (AI summaries), and Paddle (payments). Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts, omissions, outages, or changes. See our Privacy Policy for how data is handled.

10. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law or our providers. Sections relating to disclaimers, liability, intellectual property, and indemnification survive termination.

11. Indemnification

You agree to indemnify and hold harmless GEX Session Monitor and its operator from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your trading or investment decisions, or your breach of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, by notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of [your country/state of establishment], without regard to conflict-of-laws principles. Any dispute will be subject to the exclusive jurisdiction of the competent courts located there, except where mandatory consumer-protection law provides otherwise.
